Statewide Defense of Charges for Drug Distribution, Drug Possession & Prescription Drug Charges

Street drugs such as heroin, cocaine, LSD and methamphetamine are illegal to possess or distribute in New Jersey under any circumstance. Possession or distribution of any controlled dangerous substance (“CDS”) is also unlawful under N.J.S.A. 2C:35-10 without a valid prescription or license to do so. Prescription legend drugs fall within this category and are regulated by N.J.S.A. 2C:35-10.5. (1) Drug Distribution. Most drug and CDS distribution offense arise out of N.J.S.A. 2C:35-5. This statute makes it illegal to manufacture, distribute, sell or possess drugs with intent to distribute unless you are a licensed physician or pharmacist. The consequences of violating this law depend on the type and quantity of CDS involved with separate and additional charges arising if the conduct is within 1,000 feet of school property (i.e. school zone) or within 500 feet of a public park (i.e. public park or housing project zone). (2) Drug Possession. When someone is arrested for possession of CDS, the law that is implicated most often is N.J.S.A. 2C:35-10. Possession of less than 50 grams of marijuana or less than 5 grams of hashish is a disorderly persons offense under this statute. Possessing 4 or fewer dosage units of Oxycodone, Hydrocodone, Percocet, Valium, Xanax, Suboxone or another prescription drug is also a disorderly persons offense. Charges falling within this grade are municipal court drug offenses. It is a crime of the third degree or fourth degree, charges falling under the jurisdiction of the Superior Court, when someone possesses cocaine, Ecstasy, MDMA, LSD, heroin or any other drug. (3) Prescription Drug Charges. CDS that falls within the category of “prescription legend drugs” are those that can only be obtained in accordance with a prescription issued by a physician, dentist or veterinarian. These drugs typically bear the label “RX only”.  Charges of this nature are governed by 2C:35-10.5 which applies to the illegal possession or distribution of prescription drugs.
